Our enquiries among leading QCs found that most had no appetite to become judges citing hostile media coverage, lack of respect for the judiciary, relatively modest pay and pension packages, a backlog of distressing child sex abuse cases and concerns over judicial independence as well as the isolation and strenuous work load.

The Lord President, Lord Carloway, is known to be concerned about the situation and anecdotal evidence largely chimes with our findings.

Many advocates and solicitor-advocates have no intention of applying to become Senators of the College of Justice – confirming the Lord President’s concerns regarding recruitment.

A career on the bench, once considered a natural progression for an experienced QC and the pinnacle of a successful legal career, is no longer necessarily an attractive proposition for the most able members of the Scottish bar.

‘Open justice’ in family proceedings

As a High Court judge (Mostyn J) has commented (in Appleton & Anor v News Group Newspapers Ltd & Anor [2015] EWHC 2689 (Fam), [2016] 2 FLR 1) rights to open justice in family proceedings are a mess; though – sad to say, and as will be seen below (the Carmarthenshire case) – he has done his own bit to stir the muddled pot.

Family lawyers are debating whether financial relief hearings (an important part of the family courts’ work) should be in open court or in private (as FPR 2010 r 27.10 – though without any statutory or common law underlay) says they must be. Different Family Division judges take different views (and Mostyn J is one of the noisier ones on the subject).

Sony. Netflix. And now, HBO.

While the 2014 hacking at Sony Pictures pushed entertainment giants to take computer security more seriously, recent incidents have exposed weaknesses throughout Hollywood’s food chain. Last week, as HBO investigated a cyberattack on its own systems, an unaired episode of its hit show “Game of Thrones” appeared online following an unrelated breach at a pay-TV partner in India. In April, when 10 episodes of Netflix Inc.’s “Orange Is the New Black” leaked, the incident was traced to a contractor.
